Acceptance of Terms
Agreement to terms
By accessing and using the Pointerix Technologies website (pointerix.com) or engaging our services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Updates to terms
We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms. We will notify clients of significant changes via email.
Our Services
Scope of work
Pointerix Technologies provides web development, mobile app development, 3D design, UI/UX design, SEO, digital marketing, Google Ads management, Meta Ads management, and custom software development services.
Project agreements
All project work is governed by a separate project agreement or statement of work that outlines specific deliverables, timelines, pricing, and revision rounds. These Terms of Service apply in addition to any project-specific agreements.
Service availability
We operate Monday through Saturday, 9AM to 7PM IST. We aim to respond to all inquiries within 24 hours on working days.
Payment Terms
Payment structure
Standard projects require 50% advance payment before work begins and 50% upon project completion and delivery. For larger projects (₹50,000+), payment may be split into 3 installments as agreed in the project contract.
Payment methods
We accept UPI, bank transfer (NEFT/IMPS/RTGS), and international wire transfers. Payment details will be provided in your project invoice. For international clients, we accept PayPal and wire transfers in USD.
Late payments
Projects will be paused if payment is overdue by more than 7 days. Completed work will not be handed over until full payment is received. A late fee of 2% per month may be applied to overdue balances.
Intellectual Property
Ownership upon full payment
Upon receipt of full payment, the client receives full ownership of all custom code, designs, and assets created specifically for their project. This includes source files, codebase, and design files.
Third-party components
Projects may include open-source libraries, fonts, or stock assets with their own licenses. We will disclose all third-party components used and their respective licenses.
Portfolio rights
Unless expressly agreed otherwise in writing, Pointerix Technologies reserves the right to showcase completed work in our portfolio, case studies, and marketing materials.
Revisions & Changes
Included revisions
Each project package includes a defined number of revision rounds as specified in your project agreement. Starter projects include 1 round, Growth projects include 3 rounds, and Enterprise projects include unlimited revisions.
Scope changes
Changes to the agreed project scope after work has begun will be quoted separately and may affect the project timeline. We will always seek written approval before proceeding with out-of-scope work.
Limitation of Liability
Service warranty
We provide a 30-day warranty on all delivered work covering bugs and defects directly caused by our implementation. This does not cover issues arising from client-made changes or third-party service failures.
Limitation of damages
Pointerix Technologies total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific service in question. We are not liable for indirect, incidental, or consequential damages.
Force majeure
We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, internet outages, or third-party service disruptions.
Termination
Client-initiated termination
Clients may terminate a project at any time. Payment for all work completed up to the termination date is due. The advance payment is non-refundable. Any work completed will be delivered upon receipt of outstanding payment.
Our right to terminate
We reserve the right to terminate a project if the client engages in abusive behavior, requests illegal content, or fails to make payments as agreed. In such cases, payment for completed work remains due.
Governing Law
Jurisdiction
These terms are governed by the laws of India. Any disputes arising from these terms or our services shall be subject to the jurisdiction of courts in Gurugram, Haryana, India.
Dispute resolution
We encourage resolving disputes amicably through direct communication. If a resolution cannot be reached, disputes may be submitted to arbitration before pursuing court action.
